We are seeking a highly skilled legal professional to join our team as a Home Loans Defended Matters Specialist.

Based in Johannesburg (Hybrid role), this full-time position is for the legal expert who thrives in high-stakes litigation, negotiation, and strategic advisory within the complex world of home loans.

The Role: Managing Litigation and Risk

You will be the central point for managing a critical portfolio of defended legal matters involving Absa’s home loans. This means overseeing everything from trial preparation and applications to complex appeals and settlement negotiations. You won’t just follow legal processes; you will provide strategic counsel that protects our assets and ensures compliance across the board.

Key Responsibilities: What You’ll Be Driving

Your expertise will ensure the effective resolution of cases and the proactive management of legal risk.

1. Litigation & Case Management

• Portfolio Management: Manage an active portfolio covering all defended matters—including trials, applications, and appeals—and the sensitive Rescission Application portfolio.
• Case Strategy: After a Plea is received, you will review it and initiate necessary internal protocols, providing strategic direction for litigation.
• External Liaison: Engage daily with external attorneys and counsel, coordinating all documentation, recalculations, and information required for trial purposes.
• Fraud Management: Oversee and manage the Fraud Portfolio related to Home Loans, providing critical support to the broader Litigation team.

2. Compliance, Reporting & Strategy

• Legal Expertise: Provide strategic legal advice and risk assessments on all defended matters, ensuring every action aligns with the National Credit Act, High Court Rules, Magistrates’ Court Rules, and all related legislation.
• Cost & Compliance Control: Manage the legal costs for all Defended Home Loans Accounts, adhering to financial policies.
• Insight & Monitoring: Monitor legal trends and case law developments that impact home loan litigation and ensure continuous compliance with internal policies.
• Reporting: Compile and share crucial reports with the Group Litigation team, and conduct monthly review meetings to align on strategy.

What You’ll Need to Join Our Legal Team

This role requires a dedicated professional with proven experience in litigation and a sharp focus on the financial services sector.

• Education: An LLB Degree is required.
• Professional Status: Admission as an attorney would be highly preferable.
• Experience: A minimum of 2 years’ experience in litigation, specifically with a strong focus on defended matters within the financial services or banking sector.
• Skills: You must possess excellent negotiation, analytical, and communication skills, along with the ability to work independently and manage high-pressure situations effectively.
